Terms Of Service

These terms apply to your use of hearthfell.com and to every order you place with Hearthfell LLC. Placing an order means you accept them, together with our Shipping Policy, Return & Refund Policy, Payment Policy and Privacy Policy, which form part of these terms. Where a summary here differs from one of those policies, the policy governs.
If anything is unclear, email support@hearthfell.com and we'll explain it in plain language.

The store runs on Shopify, which provides the platform and the checkout. Your contract for any purchase is with Hearthfell LLC alone; Shopify is not a party to it.
2. Payment processing
Payments are processed by Shopify Payments and, where you choose it, PayPal. Charges appear on your statement as HEARTHFELL.COM or PAYPAL *HEARTHFELL. Full details are in our Payment Policy.
3. Who can order
You must be 18 or older to place an order yourself. If you're younger, a parent or legal guardian needs to place it for you.
Guest checkout is available; an account is optional. If you create one, keep your password to yourself and tell us straight away if you think someone else has used it. What happens under your account is your responsibility.
Give us accurate shipping and contact details and keep them current; we rely on them to deliver your order and to reach you if a question comes up.
We sell to individuals for personal and household use. We may decline or limit orders that appear to be for resale, including repeated orders to the same address or on the same payment method.
4. Prices, tax and duties
Prices are in US dollars. Where sales tax applies, it's calculated from your shipping address at checkout and shown before you confirm.
Shipping is free on every order. If your order ships from a fulfillment center outside the United States, all customs duties and import fees are paid by us; nothing is collected from you on delivery.
The price that applies is the one shown when you place the order and in your confirmation email. Later price changes don't affect confirmed orders. Obvious pricing errors, such as a missing digit, aren't binding on us; if one affects your order, we'll contact you and you can buy at the correct price or cancel that item for a full refund.
5. Promotions and discount codes
Discount codes are entered at checkout and can't be applied afterwards. One code per order unless the promotion says otherwise; codes have no cash value. Promotions run for the period and on the terms stated with them. If you return an item bought at a discount, we refund what you actually paid for it, and sale items can be returned on the same terms as anything else.
6. When your order becomes a contract
Listing a product on the site is an invitation to order, not a binding offer. When you complete checkout, you make an offer to buy.
The email you receive immediately afterwards confirms that we've received your order; it isn't an acceptance. The contract is formed when we send you the shipping confirmation.
Until then we may decline an order if the item is out of stock, payment can't be authorized, we've found a pricing or description error, a fulfillment problem prevents completion, or we reasonably suspect fraud. If we've taken payment and decline, we refund it in full.
No confirmation within a couple of hours? Check your spam folder before contacting us.
7. Payment
You pay when you place the order, using any method shown at checkout. By paying, you authorize the charge for the total amount due and confirm you're entitled to use that payment method. Card details go directly to the payment processor and never touch our systems; we don't store full card numbers. If a payment is declined or reversed, we may cancel the order.
8. Delivery
Processing and transit times are in our Shipping Policy. They're estimates based on normal operations, not guaranteed dates; carrier delays, weather and customs processing are outside our control, though we'll help you trace anything that's late.
Risk of loss passes to you when the package is delivered to the address you gave us, not when it's handed to the carrier. If the order arrives damaged, or doesn't arrive, tell us and we'll deal with the carrier.
If we can't ship within the stated timeframe, or within 30 days of your order where none was stated, we'll notify you and you can wait for a revised date or cancel for a full refund, as required by the FTC Mail Order Rule. If a package comes back to us because the address you gave was wrong or incomplete, you choose between reshipment and a full refund.
9. Returns and cancellations
Our Return & Refund Policy governs. In brief:
- 30 days from delivery to request a return, for any reason, sale items included
- Items should be unused, complete and in their original packaging
- No restocking fee
- Return shipping for a change-of-mind return is paid by you; when the item is defective, damaged or not what you ordered, we pay and send a prepaid label
- Refunds are issued within 7 business days of our receiving the return, to your original payment method
- Made-to-order and personalized items, hygiene-sealed items once opened, and gift cards can't be returned; this is stated on the product page before you buy
- The return address is provided when you start a return and is never our business address
You can cancel free of charge at any time before your order ships. After that, receive it and use the return process.
10. Defective, damaged or wrong items
If a product arrives with a defect, is damaged in transit, or isn't what you ordered, contact us within 30 days of delivery with your order number and photos. You choose a replacement or a full refund, and we cover any return shipping.
Everything we sell comes with the implied warranties of merchantability and fitness for ordinary purpose that Florida law and the law of your state provide. These terms don't take them away; section 17 explains what we do and don't limit.
11. Using products safely
Use products only for their intended purpose and follow any instructions, warnings and age guidance supplied with them. Read manufacturer instructions before assembling, mounting, hanging or plugging in any item. We're not responsible for injury, loss or damage that results from misuse, modification, improper installation, or ignoring instructions or warnings that came with the product.
12. Product information and dimensions
We show products as accurately as we can: photos, materials, and dimensions in inches and centimeters. Screens vary, so colors and finishes can differ slightly from what you see, and dimensions are approximate unless stated as exact. If a measurement matters for your space, ask before you order and we'll confirm it from the product's specification.
Range, prices and availability can change without notice. We may withdraw a product and limit quantities per order or per customer. If we find an error in a description or price after you've ordered, we'll tell you and you can proceed or cancel for a full refund.
13. Content and intellectual property
The text, product photography, graphics, logos and design of the site belong to Hearthfell LLC or its licensors and are protected by copyright and trademark law. You may browse and shop; copying, republishing, selling or commercial use of any content, or removing any copyright notice, requires our written permission.
14. Reviews and content you send us
If you submit a review, photo, suggestion or comment, you keep ownership but grant us a royalty-free, non-exclusive, transferable, perpetual right to use, edit, translate and publish it in any channel for our business purposes.
You confirm the content is yours or shared with permission, reflects your own genuine experience, and doesn't contain anything unlawful, defamatory, obscene or malicious. We may decline to publish or remove content that doesn't meet these conditions, and we aren't obliged to keep submissions confidential or pay for them.
15. Acceptable use
Use the site only for lawful purposes. You may not use it to break the law, infringe anyone's rights, submit false information, spread malicious code, collect other people's personal information, spam, phish, scrape or crawl without permission, reverse engineer any part of the site, or interfere with its security or normal operation. Automated tools acting on someone's behalf may use the site only if they identify themselves as automated and don't bypass technical safeguards.
If you materially breach these terms we may restrict or end your access. Orders already accepted will still be fulfilled.
16. Links to other sites, and site availability
The site may link to or use websites and services operated by others. We don't control them and aren't responsible for their content, security or practices; complaints about a third party's products or services go to that party.
We may change, suspend or discontinue any part of the site at any time and can't guarantee uninterrupted availability. Nothing in this section affects an order we've already accepted.
17. Liability
We don't promise that the site will always be available or error-free, and the site itself is provided "as is."
Our total liability in connection with an order is limited to the amount you paid for it. We aren't liable for indirect, incidental, consequential or special loss, such as lost profits or lost data.
These limits don't apply to fraud, to personal injury caused by our negligence, to the implied warranties in section 10, or to any liability the law doesn't allow us to exclude. Some states don't permit certain limitations, so parts of this section may not apply to you. Nothing in these terms reduces your rights under the consumer protection laws of Florida, of your own state, or of the United States, including the Florida Deceptive and Unfair Trade Practices Act.
18. Indemnification
If your breach of these terms or of the law, or your infringement of a third party's rights, results in a claim against Hearthfell LLC, you agree to cover our reasonable costs of dealing with it, including reasonable attorneys' fees. We'll notify you of any such claim and give you a chance to respond before settling.
19. Privacy and cookies
How we handle your personal information, what Shopify processes as our platform provider, and how cookies work on the site are set out in our Privacy Policy. Disabling essential cookies will prevent checkout from working.
20. Changes, assignment and severability
We may update these terms when the store or the law changes. The current version is always on this page with the date at the top, and changes don't apply to orders placed before they were published.
We may assign our rights and obligations to another company provided your rights aren't reduced; you may not assign yours without our consent. If any provision is found unenforceable, the rest remain in force, and not enforcing a provision once doesn't waive it. These terms and the policies they reference are the entire agreement between you and Hearthfell LLC.
21. Governing law and disputes
These terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules.
Contact us first if something goes wrong; nearly every issue is settled by email, and we'd much rather resolve it than have you dispute a charge with your bank. Any dispute that can't be resolved that way will be heard in the state or federal courts located in Duval County, Florida. That doesn't prevent you from bringing a claim in the small claims court where you live, or from relying on the consumer protection laws of your own state.
